政府职能转变的理论框架及其改进路径研究——以上海自贸区监管制度改革为例

The Theoretical Framework for the Transformation of the Governmental Function and Its Improvement——Taking as an Example the Reform of One Regulatory System in Shanghai Free Trade Zone

政府职能转变包括政府职能自转变和政府职能转移两个方面。本研究引入和借鉴了Stevcn C0hen私有化策略分析框架,将其责任和功能的二维分析框架扩展为权力、责任和功能的三维分析框架。然后对其私有化分析框架的具体内容进行了文本解读、关键词摘选、适用性分析的研究。在此基础上,构建了政府职能转变的监管制度分析框架。利用该框架对上海自贸区监管制度的一项制度创新进行了分析,发现:上海自贸区制度改革仍旧是以政府职能自转变为主,需要在政府职能转移方面拓展改革空间。

The transformation of the governmental function takes on two forms： self-transformation or functional shift. With reference to Steven Cohen＇ s analytical framework for privatization strategies, this paper expands his two-dimensional analysis of responsibility and function to three dimensions： power, responsibility and function. Through a close textual reading, study of the key words, and analysis of the applicability of Cohen＇s framework, this paper proposes an analytical framework for regulating the transformation of the governmental function. Meanwhile, this framework is used to analyze the reform of one regulatory system in Shanghai free trade zone, and the result shows that this reform still belongs to the self-transformation of the governmental function and thus reveals that more effort should be made in terms of the functional shift of the governmental function.
