土地承包经营权信托流转中受托人的法律规制研究

土地承包经营权信托是我国土地流转的一种创新形式。对于受托人进行法律规制,是土地承包经营权信托法律制度的核心内容。其对于保障农民权益、信托业健康发展以及涉农特殊政策落实均具有重要意义。商业信托公司应当成为土地承包经营权信托受托人的基本组织形态,符合条件的自然人或其他组织也可成为土地承包经营权信托的受托人。对于受托人的法律规制,应当从事前的资格要求、事中的行为控制、事后的责任追究三个维度系统进行。

Trust transfer is a new transfer form of rural land contractual management right. The legal regulation of trustee is the core content of the legal system of rural land contractual management right. It is very important to protect the interests of farms, to develop healthily the trust industry and implement agricultural policies. Commercial trust company should become the basic form of trustee, citizen or other organizations should also become trustee of rural land contractual management right. The trustee should be regulated from several aspects including qualifications, behavior standard and legal responsibility.
