农村土地承包经营权确权登记工作问题研究——以山东省三市为例

Study of the Problems in Affi rmation and Registration of Rural Land Contracted Management Right——Taking Three Cities of Shandong Province as an Example

本文以山东德州、菏泽、济宁三市的82个农村试点为研究对象,通过实际工作、实地调研、村民访谈、小组讨论等形式归纳分析了土地确权工作中出现的村民认知、权属争议、组织管理、技术规范等各项问题。结果显示:1农民土地权属意识薄弱、认知模糊,基本权利的行使未得到很好保障;2历史遗留问题较多,确权过程中农民争议不断,矛盾凸显;3测绘人员技术参差不齐,实施规范不统一,行业规范性较差。最后,针对确权过程中出现的问题并结合相关政策提出可行的对策建议。

Taking 82 pilot villages in Dezhou, paper analyzes the problems such as villagers＇ Heze and Jining cities, Shandong Province as the research objectives, the cognition, dispute of ownership, organization and management as well as technical standardization in rural land affirmation through practical work, on-the-spot investigation, villages＇ interview and group discussion. The results show： （1） the farmers don＇ t have strong and clear consciousness of land ownership, and their exercise of basic rights cannot be well guaranteed; （2） disputes increasingly arise and contradictions highlight in the process the affirmation; （3） the survey and mapping industry doesn＇ t have unified standards, and the quality is irregular. Finally, this paper puts forward feasible countermeasures combined with relevant policies.
