The legislative process of a legal rule is very important for us to deeply understand its connotation and discuss its development trend and perfecting direction.Through comparatively studying the legislative processes of the rule of exclusion of illegal evidence between China and the USA,combining with the considerations of criminal law value under the rule of law in deferent phases,this article simply combs the evolution course of the exclusion rule of illegal evidence in China,in order to provide some reference to deeply discussing the valuc basis of the exclusion rule of illegal evidence.
