On the relationship between administrative identity and administrative acts

一个正当的行政身份是一个合法有效行政行为的前提和基础,而行政行为又是行政身份的表现。现实的实践生活中,行政身份的界定并不像理论上那么清晰,行政身份与行政行为的关系也没有那么明显的定论。行政身份受上下班时间的影响,同时超越职权、冒充行政人员身份的现象也屡见不鲜,这些都势必影响着由此行政身份所负载的行政职权以及由此行政职权所做出的行政行为的成立与效力。

A proper administrative identity is a prerequisite and basis for valid administrative acts, while the administrative act is the performance of the administrative identity. In real life, the definition of administrative identity is not as clear as in theory, and the relationship between the administrative identity and administrative acts is not so obvious. The administrative identity affected by commuting time and the common phenomenon of beyond the authority or being passed off as administrative identity are bound to affect the administrative authority and the establishment and effectiveness of the administrative authority.
