虐童行为刑法规制研究——兼论《刑法修正案(九)(草案)》虐待罪的修改

The Legal Regulation of The Child Abuse Behavior——On The Modification of the Crime of Abuse in the Criminal Law Amendment( nine) Draft

家长虐待小孩、老师虐待学生现象的层出不穷不得不引起我们的重视。虐待不仅对儿童身体造成巨大伤害,精神上更是留下难以抹去的阴影,儿童权益的保护迫在眉睫。该文分析我国法律对儿童保护的现状及存在的一些问题,并对刑法修正案(九)草案中虐待罪修改进行辩证分析,为完善刑法对儿童的保护提出几点建议。

Parents and teachers of child abuse is common.This kind of phenomenon must draw our attention .Abuse not only poses a great harm to children＇s physical and is more difficult to erase the shadow in the mental.Protecting children＇s rights is imminent .This paper analyses the current situation of our country law on child protection and the existing problems ,and makes a dialectical analysis about the abuse crime in the criminal law amendment （9）draft to improve the criminal law on the protection of children to make a few suggestions.
