At first, the article introduces the background of technical standard patent pool, then explain the incentive effect of technical standard patent pool distinguish between inside and outside, and explore the jurisprudence basis behind the incentive effect. Hereby give suggestions to bring incentive effect into full play, so as to promote the development of independent innovation.
