空气污染跨域治理的法律对策研究

A Study on Legal Countermeasures of Cross-Regional Air Pollution Governance

近年来大规模空气污染与灰霾事件频发,已经影响到经济与社会的正常运转,危害到公众的生命健康。法律规制是空气污染区域联防联治的重要措施,文章从区域空气污染现状与联防联治立法现状角度展开论述,阐述法律规制空气污染联防联治的必要性,概括空气污染区域防治的法制现状与缺陷。通过实证研究,在中外比较分析的基础上,提出完善我国空气污染区域联防联治法律制度的对策建议。

In recent years, large-scale air pollution frequently occurred and affected the normal functioning of the economy and society and endangered the lives and health of the public as well. Legal regulation of air pollution in the area is an important measure to prevent and treat air pollution. This article, from the views of the Regional Air Status and Prevention legislation, discusses the need of legal regulation of air pollution, and summarizes the fact and defects of regional air pollution prevent legislation. Based on the empirical research method and a comparative analysis of China and foreign, the paper makes some suggestions to improve China＇s local air pollution prevention legal system.
