摘要
2012年新修改的《刑事诉讼法》对最高人民法院的死刑复核程序作了修改,对高级人民法院复核死刑和核准死缓程序没有修改。因此,关于死刑复核程序,仍然存在很多的问题,法律规定的相关内容仍存在很多漏洞。从法条出发,研究死刑复核程序的概念、性质以及解决办法,旨在解决死刑复核程序存在的学理与实践问题。
The new revised Criminal Procedure Law in 2012 modified the death penalty review process for Supreme People＇s Court, but the High People＇s Court did not mention that. Therefore, there still exist problems in death penalty review process and flaws in relevant content. Based on the articles, this paper explores the concept, nature and solutions on death penalty review process to deal with the problems of theory and practice in it.
