网络谣言的法律规制问题探讨

Discussion about Legal Regulation of Canard Online

网络谣言比传统谣言具有更大的危害,而我国法律在网络谣言规制问题上存在着刑法、行政法及诉讼法等立法不够完善及司法不够严谨科学之缺陷,为促进我国法治建设,有必要对这些缺陷进行分析,并结合网络谣言之特点提出完善罪名体系和诉讼制度、加大处罚力度及建立科学量化标准等建议。

Compared with traditional canard,canard online has greater harm,while there are some defects such as the incomplete legislation of criminal law,administrative law and procedural law and justice lack of strictness in the adjustment of it by positive law. In order to promote the legal system construction,it is necessary to analyze these defects and make some suggestions, for instance,perfection of accusal system and litigation system,strengthening of sanctions,establishment of scientific quantitative criteria.
