我国社区矫正审前社会调查评估研究——以法院委托调查为视角

On the Pre- trial Investigation and Assessment of the Community Correction in China——From the Perspective of the Commissioned Investigation by the Court

在我国量刑规范化改革和社区矫正推行背景下,一些法院对审前社会调查评估做了探索。但实施中,审前调查评估委托权的划分与侦查、控诉讼职能存在冲突,委托中的"双发"或"三发"现象反映出法院在确定调查评估机构时面临困境。审前调查评估超期现象普遍,审前调查评估质量不高,调查评估报告的审查机制不完善。应当合理划分审前调查评估委托权,明确规定法院和检察机关行使委托权的分工与职责,增强调查评估主体的专业性,合理界定接受调查评估委托的管辖标准和审前调查评估的适用范围,明确审前调查评估报告的属性,规范调查评估报告的内容和形式,完善对调查评估报告的审查机制。

In China’s sentencing reform and the implementation of community correction under the background,some courts have explored in pretrial social investigation and evaluation. However,there is a conflict between the division of the commission power in the pre- trial assessment and the function of investigation and prosecution. The＂double production＂or＂triple production＂of the assessment commissions reflects the dilemma faced by the court in determining the institution of the investigation and assessment. The pre- trial investigations and assessments often exceed the time limit,and the assessments are of low quality. The review mechanism of the investigation and assessment report is imperfect. There should be a reasonable division between the commissioned power of the pretrial investigation and assessment to enhance the professionalism of the subjects,to explicit the nature of the pre- trial investigation and assessment reports,to standardize the contents and form of the investigation and assessment report,and improve the review mechanism of the assessment report.
