输气管网“非歧视性”第三方准入制度解析

Analysis on the Third Party Access System of the "Non Discriminatory" of the Gas Transmission Pipeline Network

输气管道第三方准入制度对促进天然气市场进入竞争起着重要作用,我国正试图在国内输气管道市场中引入第三方准入制度,为了使得国内第三方准入制度的制定公平有效,需参考研究欧盟颁布的2009/73/EC和715/2009指令中"非歧视性"内容,即管道运营商必须消除对所有用户的歧视。研究分析了输气管网系统用户被同等对待的背景情况,阐明了非歧视性第三方准入规则中"歧视"的含义。指出我国在制定第三方准入制度时,须考虑管网用户之间的差异,使得管道公司在消除歧视的基础上能公平对待不同用户。

The third party access system of gas pipeline is very important for promoting the competition of the natural gas market.China is trying to introduce the third party access system in the domestic gas pipeline market. In order to make the third party access system develop fairly and effectively, there is a need to refer to the EU promulgated 2009 / 73 / / 715 / 2009 of the 'non discriminatory' content- pipeline operators must eliminate discrimination against all users. This paper analyzes the background information of the users of the gas transmission pipeline network and clarifies themeaning of the 'discrimination' in the non discriminatory third party access rules. Meanwhile, it also points out that in the development of the third party access system, we must consider the differences between the network users, so that the pipeline companies can treat different users fairly without discrimination.
