Legislative Argumentation: Legitimacy Basis of Modern Law

法律如何获得正当性是困扰现代法治国家的一个核心问题。而对于正当性概念自古就有主观和客观两种面相的争论。发展至今,程序规则成为主客观统一的中介。于是,有关法律正当性的讨论也就自然而然地落在了有关立法程序规则的设置上。对此,本文进一步认为,只有确保实现充分论证的立法程序规则才能发挥其向法律输入正当性的功能,因此,是立法论证构筑了现代法律的正当性基础。

How law becomes legitimate is a core issue for a country ruled by law. There are subjec- tive and objective arguments as to the concept. So far, procedure regulations are a medi- um of integration for subjectivity and objectivity. As a result, relevant discussions center on regulations for legislative procedures. It is argued that the guarantee of full argumenta- tion for legislative procedure rea, ulations is the legitimate basis of modem law.
