仁道司法的内涵及其现代价值

Humane Connotation and Its Modern Value of Justice

儒家所倡导的仁政思想与传统司法之间存在着紧密的联系。一方面,"刑不中,则民无所措手足",追求公平正义的司法是实现仁政的前提条件;另一方面,仁政的理念规范了传统司法的内容和价值。因此,古代的司法理念可以概括为追求"仁道"的司法。仁道司法的提出是对司法权内容上的规范,核心在于法中求仁的司法目的。法中求仁是传统司法的目的和核心价值,司法的目的不在于惩戒罪犯而在于通过司法实现社会的公正、恢复社会秩序,从而实现儒家的仁政理想。因此,法中求罪不利于社会和谐,法中求仁才能使百姓发自内心的接受司法裁判。

Benevolent governance ideology advocated br Confucian is closely linked with traditional judicial. On the one hand, ＂if the penalty is not suitable, the people do not know what course to take＂, the pursuit of fairness and justice of judicature is the basic condition of benevolent governance; on the other hand, the idea of benevolent governance norms the contents and value of traditional judicature. Therefore, the ancient judicial philosophy can be summarized as the pursuit of ＂benevolent judicature＂ which normalizes the content of jurisdiction and put the pur- suing of benvolence as the core. The purpose of traditional judicature lies not in punishing the criminals but in real- izing social justice and restoring social order, so as to realize the doctrine of the Confucian ideal. Therefore, pursu- ing sin in judicature is not conducive to social harmony, pursuing sin in benevolence in judicature is the right way to make people accept judicial referee genuinely .
