窦融保据时期河西社会法律纠纷浅探——以《建武三年候粟君所责寇恩事》册为中心

"寇恩"册是现出土的居延新简中比较重要的一份,记载了发生在建武三年(公元27年)的一宗债务诉讼案。考察简文可知,粟君与华商、周育之间并不存在债务关系,其从华商、周育二人处所得牛、谷,实为敲诈所得。"恩辞不与候书相应疑非实",反映出县廷在处理这件民事纠纷时并不偏袒为官者,相反,对普通百姓还给予一定的照顾。由于寇恩可能懂法,所以既赢了官司,还运用法律手段惩处了自己的对手与上司粟君。

＂Kou- en＂book is a relatively important Juyan new Jane unearthed which records a debt litigation occurred in the third year of Jianwu（ A. D, 27）. And it may result from the fact that Cohn may know the law so as to both win the lawsuit and use legal means to punish opponents and his boss Su Jun.
