Discussion on the Succession System of Collective Land Use Right

我国集体土地使用权继承制度的设计存在一定问题,没有兼顾到非本集体经济组织成员继承人的合理诉求。放开对集体土地使用权继承的身份限制,是《物权法》、《继承法》以及房屋特点的内在要求,且并不与我国耕地保护政策和社会稳定相矛盾。因此,建立一套完整的集体土地使用权继承制度,是当前农村土地立法的一个重要方向。

The purposes of this paper are to point out that there are some problems on the Succession system of our country collective land use right because it doesn’t take into account the reasonable demands as the Successor of non- members of this collective economic organization.Methods employed include case analysis and empirical analysis.The results indicate:1 )it is the inner require of the Real Right Law and the Law of Succession and housing characteristics that release the restriction on succession of the collective land use right ;2)release the restriction on succession of the collective land use right and the policy of protection cultivated land and social stability does not contradict.It is concluded that the important content of current rural land legislation is to establish a complete the succession system of collective land use right on the legislative.
