摘要
企业规章制度制定与劳工权益保护是企业这驾马车的两个轮子,应并行不悖。但随着经济结构的不断调整和经济的多元化发展,二者对立的情况在现实中经常出现,其主要表现是,企业规章制度中的某些条款与劳工权益保护的要求不符。劳动法规定,企业规章制度的内容必须符合我国法律法规及国家政策;其制定程序必须体现民主,要有劳方参与共议,而不能由资方独决。未经劳方参与共议的规章制度,如果其中主要规定劳动者的义务而排除劳动者的主要权利,那么它就是无效的。劳动者基于违法的、无效的规章制度争议而停工、怠工是合法的维权行为。
With the development of pluralism of economy,the relationship between labor rights and enterprise rules is in tension. The growth of labor law requests the content of enterprise’s rules and regulations to be established complying with Chinese laws,regulations and national policies. Its procedures must reflect the democratic process,labor’s involvement in the discussion together,rather than the management’ resolution alone. The establishment of the rules and regulations of enterprise without labor’s participation,if its main content sets laborer’s obligations but excludes laborer’s rights,is considered invalid format clause.
