略论领导干部干预司法活动记录制度

On Recording System of the Intervention to the Judicial Activities by Leading Cadres

我国法律明确规定,人民法院、人民检察院依照法律规定独立行使审判权、检察权,不受行政机关、社会团体和个人的干涉。为防止领导干部的不当干预,中共中央出台了《领导干部干预司法活动、插手具体案件处理的记录、通报和责任追究规定》。其中,领导干部干预司法活动的记录制度对于整个制度的实施有着基础性的作用。记录制度可以从记录的主体、记录的内容和方式以及对记录行为的监督与对不记录行为的追责四个方面进行完善。

Laws in our country stipulate explicitly that the People＇s court and the People＇s procuratorate exercise adjudicative and procuratorial powers independently, not subject to interference by administrative organs, social organizations and individuals. In order to prevent improper intervention from the leading cadres, the central committee of the Communist Party of China has released Recording, Reporting and Responsibility Regulations on the Intervention to Judicial Activities by the Leading Cadres. The recording system is the fundament of the whole system. The recording system could be improved from four aspects： the implementers of recording system; the content and the way of the recording; the supervision over the recording; the responsibility of no record.
