On Ming Opera Water Margin and the Folk Consciousness of Law in Ming Dynasty

《水浒记》作为舞台表演艺术的明传奇,蕴含有深厚的民间意识,文章对《水浒记》中的吴用智取生辰纲、王妈妈与阎婆之间恩情与法理的争辩、孟氏得知宋江杀人叫宋江逃走等情节进行分析,发现中国古代民众具有以下法律意识:奸佞之臣的不义之财理当被劫;被人所崇敬的恩人犯法应该报答而不应报官;亲人朋友惹得官司,第一反应是助其逃脱官司。

The Ming opera ＂Water Margin＂ as a stage performing art contains a profound folk consciousness. This paper made an analysis of some plot of ＂Water Margin＂, such as Wu Yong robbed the birthday presents wisely, the debate between kindness and legal principles, Song Jiang＇s wife let Song Jiang run after she learned he had killed a guy etc.. We found that Chinese people in ancient time has the following legal consciousness： bad guys＇ properties should be robbed; the benefactor who broke the law should not to be reported to the police and sent to the prison; the relatives and friends who broke the law, the first reaction people should take is to help them escape instead of reporting to the government.
