集体建设用地流转中的村委会行为分析——基于委托代理理论 被引量:15

摘要 研究目的:基于委托代理理论,探讨集体建设用地流转中村委会的行为。研究方法:实地调查法。研究结果:村委会双向代理行为从总体来说促进了农村集体建设用地的有序流转,但也出现了诸如村委会权力寻租、村委会行为决策有较大不确定性和村委会双向代理风险较大等问题。村委会代理行为出现问题的原因主要包括:集体土地产权代理人市场缺乏竞争;委托人缺位;村委会代理行为受信息和规则因素的制约等。研究结论:应当规范和引导村委会的双向代理行为,具体措施包括引入竞争机制,优化代理人行为;做实农户委托人身份;优化村委会作为双向代理人的激励约束机制。 The purpose of this paper is to explore the behavior of village committee in the process of transferring collective construction land based on the principal-agent theory. The method used is the on-the-spot interview. The results show that the double agent behavior of village committee promoted the orderliness of collective construction land transfer. However, there are also some problems, such as the village committee's rent-seeking behavior, the uncertainty of decision-making behavior of the village committee, and the risk of village committee's double agent behavior. The reasons for the problems mainly include 1) the agent market of rural property right lacks competition; 2) the principal is absent; and 3) the village committee's agent behavior faces restrictions from information asymmetry and related rules etc. The paper concludes that the policy makers should pay attention to regulate and guide the double agent behaviors of the village committees. Concrete measures include introducing competition mechanism and optimizing agent behavior, reinforcing farmers' identity of principal, and optimizing the incentive and constraint mechanism for the village committee's double agent behaviors.
