建筑业工亡赔偿实际值与法定值差异性分析

Analysis of the Difference between the Actual and Legal Industrial Injury Death Compensation in Construction Industry

以河南、四川、江苏3个省份为例,将建筑业工亡法定赔偿值与实际赔偿值进行比较,发现大部分实际赔偿值低于法定值。对实际赔偿值与法定值的差异性进行分析,发现职工个人和企业对差异性的产生具有直接作用,政府起着举足轻重的间接作用。由此,提出应当以政府为出发点,充分发挥其对企业和个人的监督管理职能,最大程度上消除赔偿额的差异。

Taking three typical provinces- Henan,Sichuan and Jiangsu as the case,the actual and legal industrial injury death compensations of construction industry are compared and it is found that most actual compensations are less than those of the legal. Based on analyses of the difference between them,it can be known that individuals and employers directly affect the difference and the government indirectly affects it. Thus,it should take the government as the starting point and government＇s supervision and management to individuals and employers should also be strengthened,to eliminate the difference between the actual and legal industrial injury death compensations to the greatest extent.
