论大学职能的演进与坚守:权力“制度笼子”之建构

On the Evolution of University Function and Its Insistence:Establishing a Caging System for Power Containment

人才培养、科学研究、社会服务和文化传承创新是大学的基本职能,伴随着时代的发展,大学职能的内涵更新和外延拓展呈必然趋势。反腐倡廉职能的出现是大学职能演进的基本规律,也是新时期法治中国建设的客观要求。坚守反腐倡廉职能,把权力关进制度的笼子,实质是对高校权力实施有效制约与监督。为此,必须打牢制度教育基础,构建不能腐的防范机制;抓住权力制约监督关键,构建不易腐的保障机制;强化案件查处手段,构建不敢腐的惩戒机制;最终达到不想腐的理想境界。

Talents training, scientific research, social service as well as cultural inheritance and innovation are basic functions in universities. With the development of the times, it is necessary to renew the connotation and expand the denotation of university function. Combating corruption and building a clean university become a basic rule of the evolution of university function, and also become an objective requirement for the legal construction in China in the new period. Sticking to anti - corruption and caging power in the legal system are effective power restriction and supervision on higher educational institutions. This paper, therefore, intends to shed light on this issue with the following proposals： a solid educational foundation should be laid to construct a protecting mechanism which can not be corrupted; ought to be established as the key to grasping power restriction and supervision as the key to establish a safeguard mechanism which is not easy to corruption; enhancing the case investigation techniques and constructing the disciplinary system which make people dare not to corrupt. An ideal state is likely to be achieved ultimately with people unwilling to corrupt .
