案例的生命在于引证

对案件审理而言,案例引证制度有利于强化裁判文书说理,提升裁判结果的说服力。对司法制度而言,案例引证制度是统一裁判尺度、遏制司法滥权、提高裁判文书质量的有效手段。案例引证制度需解决引证程序和引证范围等问题。我国案例指导制度存在不足,把案例指导制度改造为案例引证制度,将有助于理清司法案例运用于审判实践的制度障碍,并从程序上予以规范化。大量有价值的案例资源和司法知识可以通过案例引证制度而重新获得生命力。

To hearing the case, the case citation system is conducive to strengthening the reasoning and the authority of the judgement. To the judicial system, the case citation system is an effective way to unify the judicial standard, contain the judicial abuse power and improve the quality of the judgement. The case citation system should resolve the problems, especially as citation procedure and the citable case. The case guidance system in China is insufficient. The reform of the case guidance system will help to clarify the obstacles which hinder the judicial cases from practice, and help to standardize the case citation procedure. The case citation system will reactive a large number of valuable cases and judicial knowledge.
