Rural Land Property Rights as a Bundle of Relationships——A Contrastive Study Based on the Structure of Village Level in Different Regions

与臧得顺的地权分析框架不同,本文以"关系产权"为学术起点,沿着"产权的社会视角"进路,借用社会网络理论资源,重新说明"关系地权"的概念、原则、类型。研究发现,"关系地权"中的"关系"是双边或多边的,关系网络的形成一方面源于国家权力和正式规则的保障与维系,一方面源于地方实践中的共同认知与相互承认。村庄结构的性质不同,对均质的外在条件的反应不同,关系变迁的速率和方向也有差异。"关系地权"的文化原则在南方农村的地权实践中占主导地位,强力原则在中部农村的地权实践中占主导地位,公平原则在北方农村的地权实践中占主导地位。

Unlike Zhang Deshun' s framework to analyze the land property rights,based on 'property rights as a bundle of relationships',this paper inherits the 'property of social perspective'route,learns from social network theory resources,finally redefines the concepts,principles,typology of 'rural land property rights as a bundle of relationships'. It is found that the 'relationship'of the 'rural land property rights as a bundle relationships'is bilateral or multilateral,on one hand,the formation of relation network is the result of the state power and the formal rules' protection and sustain,on the other hand,it is the result of the local practice for common cognition and mutual recognition. As different villages have different structures,the reaction of the homogeneous external condition is also different,ends with different relations change speed and directions. The cultural principle of 'property rights as a bundle of relationships'dominates the local practice of land property rights in the Southern Rural,while the powerful principle dominates the local practice of land property rights in the Central Rural,and the fairness principle dominates the local practice of land property rights in the Northern Rural.
