论尖端医疗领域的刑法立法原则

Legislative Principles of Criminal Law in the Field of Advanced Medicine

尖端医疗技术的发展为刑法带来了新的挑战。在理念的层面,保障"人的尊严"证立了刑法介入尖端医疗的正当性;就立法技术而言,首先要明确刑法在将相关行为入罪化时应当遵守的原则。通过澄清相关上位原则,整理刑法修改的方向、理念和规则的具体内容,参考生命科技立法的状况,结合尖端医疗领域的特点,提出了尖端医疗刑法立法必须遵循事实确定化原则、类型化原则、和谐化原则、国际化原则和前瞻化原则。

The advanced medicine has brought out new challenges to Criminal Law. On the ideal level,it is human's dignity that has been illustrated as the legitimacy basis of criminal regulation to advanced medicine. Furthermore,on the technology level,the principles of enacting new criminal provisions of advanced medicine should be clarified.By defining relevant upperseat principles,clarifying contents of directions, ideas and rules of Criminal Law's modification,referring to practice of life science and technology law,and integrating with characteristics of advanced medicine. The principles of legitimating new criminal provisions on advanced medicine have been proposed that are principle of assuring facts, principle of typing crimes,principle of harmonizing with provisions,principle of internationalizing law and principle of foreseeing risks.
