制毒物品罪研究——兼论制毒物品罪立法条款的修正

Research on the Crimes of Precursor Chemicals——on the Amendment of the Criminal Provision of Precursor Chemicals

从情节较重、行为方式发生变化、法定刑的变化、第二款条文变化四个方面,对制毒物品犯罪修正条款进行了分析,提出要统一称谓,改携带为走私,出台相关的司法解释。

The paper discusses the amendments of drug-making from four aspects of serious cases,the change of behavior patterns,statutory sentence and section 2 of Article 350. Based on the analysis, the author proposes that the appellation should be consolidated,drug-carrying should be changed into smuggle,and the related legal explanations should be introduced.
