刑事辩护的策略及其伦理底线

Criminal Defense Strategies and the Ethic Bottom Line

作为法律职业共同体之一员,辩护律师不仅肩负热忱代理之义务,亦有维护司法公正与社会正义之责。故刑事辩护之策略亦应由热忱代理的单一目标转向兼顾司法公正和社会正义的多元目标。然实践中的辩护策略却犹如剑之两刃,其在促进正义之际亦有阻碍司法公正和社会正义之虞。首要原因乃在于缺乏底线规制的辩护策略易偏离其初始目的。故为了充分发挥辩护策略之积极意义,同时有效防止其发生异化,须从辩护策略运用之多元目的出发,明确其伦理边界,并从规范层面予以规制。

As a member of the legal professional community,a defense lawyer bears not only the enthusiastic agency obligation but also assumes the responsibility for maintaining judicial fairness and social justice. Therefore,the criminal defense strategies should multiply target the judicial fairness and social justice instead of the sole agency obligation. However,in practice the defense strategies are like a double-edged sword. In the promotion of justice they may obstacle the judicial fairness and social justice. The primary reason is that defense strategies without the bottom line regulation are easy to deviate from its initial purpose. In order to exert the positive role of the defense strategies and effectively prevent the dissimilation of the strategies,ethic boundaries should be defined in the context of the multiple purposes of the defense strategies and should be regulated normally.
