试论我国法律援助条件的立法缺陷及完善

On the legislative defects and perfection of the legal aid condition in China

我国法律援助立法没有明确"法律援助条件"这一概念的内涵,导致法律援助机构在审查法律援助申请时缺乏明确的法律依据,影响了审查工作的统一性、公正性。需要从法律援助的对象、事项、管辖等方面完善现有规定,以统一法律援助申请审查工作的尺度。

Our country＇s legal aid legislation has not make clear the connotation of the legal aid condition,resulting in the lack of a clear legal basis when legal aid agencies examine the application for legal aid,so as to affect the unity and justice of the examination work. We should improve the existing regulations on the object,matters,and jurisdiction of the legal aid,in order to abtain the same standard on the legal aid application.
