摘要
从法律视角解读《国务院关于创新重点领域投融资机制鼓励社会投资的指导意见》提出的投融资方式创新,通过对排污权、收费权、特许经营权、土地承包经营权和各类预期收益的分析,梳理重点领域投融资创新举措存在的法律障碍和配套制度障碍,并相应提出修改法律和完善制度等解决对策。
This paper proposed legal analysis on the financing-of-innovative which is from China＇s State Council＇s opinions？to encourage social investment in the key areas of innovation of investment and financing system. There are legal obstacles of pledge on the emission right, toll right, franchises right, land contract and management right and all kinds of expected right. There are also obstacles on the supporting system of the financing-of-innovative.This paper proposes to amend the law and improve the relevant system.
