Certain Basic Relations Concerning FTAs

本源上的母体和本体的关系、功能上的规则创制与市场准入的关系、义务和方法上的正面清单与负面清单的关系、先占上的国际规则与国内法的关系、协调上的先后以及平等与重叠的关系,构成了自由贸易协定的几组基本关系。这些基本关系涵盖了自由贸易协定涉及的基本制度,决定着自由贸易协定的作用和方向,影响着国际贸易体制的发展路径,更规范着自由贸易协定参加方相互间的权利义务关系。因此,对这些基本关系应辩证地理解把握。

FTAs could be studied from several sets of basic relations: the relations betw een the GATT / WTO and FTAs in terms of origin,rule making and market access in terms of functions,positive list and negative list in terms of obligation and approach,international law and domestic law,as well as equality and overlapping in terms of coordination. These relations underline the basic regime of FTAs,determine the functions of FTAs,influence the development of international trading system,and define the rights and obligations of parties involved in FTAs,and therefore it is necessary to study these basic relations from a dialectical perception.
