孕妇与哺乳期妇女盗窃犯罪问题探析——基于理性选择理论的视角

A Study on Crime of Theft Committed by Pregnant and Lactating Women——Based on the Perspective of Rational Choice Theory

近年来,孕妇与哺乳期妇女的盗窃犯罪案件呈上升趋势,在社会上引起广泛关注。孕妇与哺乳期妇女是社会的弱势群体,法律本着人道主义关怀原则对孕妇或哺乳期妇女宽容处置。然而,一些孕妇与哺乳期妇女利用法律的宽容不断实施盗窃犯罪,这种特殊群体的盗窃问题值得公众重视。本文将犯罪学的理性选择理论引入孕妇与哺乳期妇女盗窃问题中,概括其盗窃犯罪现状,并根据其"收益高、风险低与成本低"三方面理性因素的理论分析,进而提出有创新性的犯罪防控建议,达到对孕妇与哺乳期妇女盗窃问题的探索性解读,从而为有效防控这类特殊群体的盗窃犯罪问题打下基础。

In recent years,cases of theft committed by pregnant and lactating women have been increasing, which has caused a widespread concern in society.As we know,pregnant and lactating women are the vul-nerable groups of society,and legal disposition for pregnant women are tolerant with the principle of human-itarianism.However,some pregnant and lactating women take advantage of the legal tolerance to commit crime.This paper starts from the current status of theft crime among pregnant and lactating women and puts forward some innovative advices on the prevention and control of crime.
