Criminal Regulations for the Litigants in Violation of Principle of Good Faith in Civil Suit

当事人违反民事诉讼诚实信用原则的行为会侵害对方当事人的财产利益和人身利益,浪费司法资源和扰乱司法秩序,同时也会损害司法权威和司法公信力。在我国现行法律框架下,实体法和程序法对当事人违反民事诉讼诚实信用原则的规制还不完善,难以遏制诉讼中的不诚信行为。为了更好的规范诉讼行为,协调民刑关系,统一法律适用,最终实现诉讼价值,有必要构建毁灭、伪造证据罪和恶意诉讼罪,通过刑法对当事人严重违反民事诉讼诚实信用原则的行为加以规制。

The litigants＇ violation of the principle of good faith in civil suit would infringe adversary＇s property and personal interests,waste judicial resources and disturb the judicial order,and damage the judicial authority and credibility. In our current legal framework,the substantive law and procedural law have incomplete regulations on the litigants＇ violation of principle of good faith in civil suit,so it is difficult to curb the acts of bad faith. In order to better regulate litigation behavior,coordinate the relationship between civil law and criminal law,unify the application of law,and eventually realize the value of litigation,it is necessary to construct the crime of destroying and forging evidence and the crime of malicious lawsuit,therefore criminal law can regulate the litigants＇ serious violation of principle of good faith in civil suit.
