案例指导制度是我国社会主义司法体系的重要组成部分,而裁判摘要无疑是我国案例指导制度的重中之重,主要概括和抽取案件中的裁判规则,统一和规范法律的适用,以起到总结、提示与指导的功能。为了达到撰写的预期目的,裁判摘要不仅应该包括法官判决理由和裁判规则,还应该涉及案件基本事实的有关内容。裁判摘要要体现出案例的精髓,理应由专门的组织和人员进行撰写,并且定期进行分类和整理。这样才能使裁判摘要和案例指导制度朝着正确的方向发展。

The case guiding system is an important part of the judicial system of socialism in China,while the abstract of judgment is the priority of this system. The abstract of judgment mainly summarizes and extracts the judge rules of the case and unifies the use of law to further summarize,prompt and guide the case. It should not only include the reason of judgment and the judge rules,but also the basic facts of the case. In addition,it should be written by specialized organization and person,and classified and sorted regularly to reflect the essence of case. Only in this way can we ensure the abstract of judgment and case guiding system to be developed in the right direction.
