我国少数民族著作权合理使用制度审思——评《著作权法》(修订草案送审稿)第43条

On the Fair Use System of China's Minority Copyright——A case study of article 43 of “Copyright Law”( revised draft)

少数民族著作权合理使用制度作为利益平衡的利器,其价值在于通过对我国少数民族语言传承保护政策的法律化,维护少数民族语言自治权,进而促进少数民族教育和文化的发展。在我国《著作权法》第三次修法之际,少数民族著作权合理使用制度面临完善的必要:合理使用的受益主体应扩张至"少数民族";合理使用的方式应多元化,宜增加对表演权、播放权、信息网络传播权的限制。

Being a useful tool for balancing interest,the Fair Use System of China＇s minority copyright legalizes the protection policies of minority language inheritance,maintains minority autonomy and thereby promotes minority education and cultural development. Therefore,it is of great significance to improve this system on the occasion of the third amending of the＂Copyright Law＂. The measures include： expanding the main beneficiaries to minority groups; diversifying the way of use; and increasing the limitations of Performing Rights,Broadcasting Rights and the Right to Network Dissemination of Information.
