The Function of Remedial Judgment of Administrative Litigation

新《中华人民共和国行政诉讼法》第七十六、七十八条明确规定了一种"新"的行政诉讼判决形式——行政诉讼补救判决,这是一种与重作判决、履行判决、赔偿判决相对独立的判决形式。补救判决所承载的弥补撤销判决、确认判决解决纠纷的不彻底性缺陷,实现行政相对人权利的实效性救济,发挥行政判决的违法责任评价功能以及提高行政诉讼效率功能,是补救判决区别于其他判决形式而独立存在的功能基础,这些并不能由其他判决形式替代的独特功能,使得补救判决能够作为一种独立的判决形式存在于整个行政判决体系中。

The 76th and 78th articles in the new “Administrative Procedure Law of the People’s Republic of China”implemented from May 1,2015 provides a new form of judgment——remedial judgment,which is a relatively independent form different from the judgment for conducting again,judgment for performance and judgment for administrative indemnity.The remedial judgment carries multi-functions such as compensating the defect caused by abrogating a judgment and confirming the incomplete settlement of the judgment,realizing effective relief of the rights of private party,playing illegal responsibility evaluation function of administrative judgment and improving efficiency of administrative litigation,all of which are basic and irreplaceable features of remedial judgment differentiating it from other forms of judgment and making it an indispensible part in the whole administrative judgment system.
