摘要
土地承包经营权抵押虽被立法所禁止,但多地试点已对其予以突破,并呈愈演愈烈之势。我国现行法禁止土地承包经营权抵押的立法理由难经推敲,不能成立,而且开禁土地承包经营权抵押不仅是理论上契合的需要,更是社会现实提出的迫切要求。除开禁抵押外,尚须修改相关条文与补充配套制度。放开土地承包经营权流转的限制、完善土地承包经营权登记制度、建立土地价值评估机制等,为土地承包经营权抵押贷款营造一个切实可行的制度环境。
