软件著作权侵权判断标准问题分析

Analysis on the judgement standard of software copyright infringement

随着计算机软件的迅速发展,软件著作权侵权纠纷快速增长,但判断一个行为是否构成软件著作权侵权涉及很多复杂的问题,文章以国内司法判例为基础,总结了实践中判断软件著作权侵权的主要标准,并提出了相关立法建议。

With the rapid development of computer software, software copyright infringement disputes emerge rapidly.However,judging whether an act constitutes a software copyright infringement involves many complex problems.Based on domestic judicial precedent, this paper summed up major standards to judge software copyright infringement in practice and put forward related legislative proposals.
