我国刑讯逼供控制的困难主要来自两个方面:首先,由于观念原因,人们实际对刑讯逼供抱有一种相对认可的态度,这不仅使控制刑讯逼供的法律制度难以完善,而且使现行相关法律制度难以实施;其次,我国现行司法体制和刑诉程序结构也不利于这些法律制度的实施。因此要有效控制刑讯逼供,一要改变对刑讯逼供的观念和态度,为相关刑事诉讼立法的完善和顺利实施创造条件;二是要改善法律实施的体制和结构环境,确保这些立法得到严格执行。
