环境犯罪“三元化”制裁体系之建构——以制裁目的之有效实现为中心展开

对环境犯罪的制裁目的是预防与恢复。为了有效实现这两重制裁目的,需要同时发挥刑罚、保安处分和恢复性制裁措施在环境犯罪制裁中的作用。然而,我国当前对环境犯罪的制裁体系显然还存在着与相应制裁目的之间的脱节,主要表现就是在制裁体系建构上的结构性缺损。为此,我国应当以刑罚、保安处分和恢复性制裁措施为中心,为环境犯罪建构起完整的"三元化"制裁体系。

Prevention and recovery are the purposes of applying sanctions against environmental crime. In order to effectively achieve the dual purposes of sanctions, we need to play the role of penalty, security measures and recovery measures at the same time in the sanctions of environmental crime. However, in our current system of environmental criminal sanctions, there is an obvious disconnect between the pur- pose and the corresponding sanctions, mainly showing the structural defect in the construction of the system of sanctions. Therefore, in our country, we should construct a complete triple-sanctions system for environmental crime, and take the penalty, security measures and recovery measures as the center.
