摘要
浙江、福建等地的"净采矿权"出让实践,创造性地对传统采矿权法律要素进行了改造,扩充了采矿权的部分权能,减少了采矿权主体的权利获取成本与实施成本,取得了较好的制度效果。但其忽视了相邻关系与地役权两类法律关系的差异,也模糊了地方政府作为法律主体的多元属性,未能采用区别化的制度手段对待"任意性规范"和"强制性规范"所属的不同法律关系。未来"净采矿权"出让制度设计应秉承现有的基本构架,辅之以区别化的制度手段。
The "net mining rights" transfer practice make a renovation on the traditional mining right legal elements, expand the power functions of the mining rights, reduce the mining rights acquisition cost and implementation cost,which has a good effect. But the difference of the neighborhood and easement, and the diversity of local government subject attribute are overlooked. Meanwhile, the peremptory norm and the permissive regulation are not treated differently by the system design. The future system design of the transfer of "net mining rights" should uphold the basic framework of the existing system, supplemented by the differentiated system means.
