论法治中国视野下警察职业思维的定位——基于“法治思维和法治方式的思考”

On the Orientation of Police as a Career under the Background of Rule of Law in China

党的十八大报告明确提出了"法治思维和法治方式"的新概念,要求广大党员干部提高运用法治思维和依法办事的能力。公安机关是代表政府实施社会管理的一个重要力量,应当以此为契机构建以法治思维为核心的警察职业思维方式,运用法治思维阐释社会现象、校正执法理念,实现由政治思维、道德思维、权力思维、经济思维向法治思维方式的转变。对广大公安民警来说,选择、树立和培育法治思维就是建立一种职业的思维方式,即要求在公安执法工作中将法治的诸种要求运用于认识、分析、判断和处理问题的过程中,注重法律至上,权利本位,正当程序和公平正义。

The report of the 18th CPC Central Committee clearly put forward the new concept of ＂thinking mode of rule of law＂, which requires all the party members and cadres to improve the ability of using legal thinking and do as the law prescribes .Public security organs as an important force representing government to execute the function of social administration shall take this opportunity to construct the thinking mode of rule of law as the core value in career , apply legal thinking to interpret social phenomenon , correct the concept of law enforcement and change from political thinking , moral thinking , power thinking , economic thinking to legal thinking .As to the ma-jority of police officers , choosing , establishing and cultivating legal thinking means the establishment of career thinking mode .This mode requires them to conduct law enforcement with the concept of rule of law and adhere to the principle of law first , proper procedure , fairness and justice .
