深入思考知识经济背景下知识产权保护对科技进步的基础性作用有着突出的学理和现实意义。必须在以权利平衡观念为底蕴的法律权利体系之上,在对我国经济社会结构和法律文化深刻理解的共识上,在与国际标准合理结合的基础上,确立适应国情的知识产权基本国策,制定统一的知识产权法典,进一步完善科技法律制度。最后,学界需要采用"知识权"这一上位概念来引领未来的理论发展和法律实践,使知识权成为与社会权一样的普惠性权利。

In knowledge economy era, in - depth study on the basic role that the protection of the intellectual property plays in promoting science and technology progress has outstanding academic and practical significance. In the legal system of rights on the basis of right balance concept, on the consensus of the deep understanding of China＇s economic and social structure and legal culture, and on the basis of reasonable adoption of international standards, we must establish the basic national policy adaptive to China＇ s situation to protect China＇ s intellectual property, formulate a unified intellectual property code, and further improve the legal system relating to science and technology. Finally, the academia should adopt the superior concept ＂right of knowledge＂ to guide the theoretical research and legal practice in the future, and make the knowledge right as prevalent as social right.
