医疗损害纠纷案件赔偿影响因素分析及赔偿模型的构建——基于1072例医疗损害纠纷案例的研究

Analyzing the factors to influence the compensation on medical damage dispute and the construction of compensation model

目的:分析我国医疗损害纠纷案例的赔偿情况与影响因素,构建医院赔偿模型。方法:对"医疗损害"为案由的1072例医疗损害纠纷案例进行方差分析、相关性分析,探索医院赔偿影响因素,应用多元回归分析方法建立模型。结果:医疗损害纠纷发生率最高为三级医院,科室分布以外科为主。二级医院、儿科、医院负次要责任,损害结局为一级到三级伤残的实赔金额最高,实赔金额与医院等级、医院责任、损害结局、索赔金额、纠纷时长呈正相关,与患者年龄呈负相关。结论:重视赔偿影响因素,降低医疗损害发生率,通过应用赔偿模型提高解决医疗纠纷的效率。

Objective To analyze the status of compensation on medical damage dispute in China and its influencing factors, and construct the model of hospital compensation. Methods 1072 cases of medical damage disputes were analyzed with variance and correlation analysis to explore the influencing factors of hospital compensation. And the model of hospital compensation was devel- oped with multiple regression analysis method. Results The highest incidence of medical damage disputes was in grade three hospi- tals, which main occurred in surgical departments. Grade one to three disability got the highest compensation. The amount of com- pensation was positively correlated with the grade of hospitals, hospitals＇ responsibility, outcome, claiming amount and duration of dispute, and negatively correlated with patients＇ age. Conclusion The influencing factors of compensation should be paid attention to. The occurrence of medical damage needs to be reduced. And the efficiency of dealing with medical disputes can be improved by applying the compensation model.
