人工受孕体在当代意大利立法和判例中的地位被引量：15

摘要现行《意大利刑法典》以及合同法判例赋予自然受孕体受保护的客体的地位,《意大利民法典》赋予自然受孕体附解除条件的主体的地位。但《医学辅助生殖规范》赋予了人工受孕体主体的地位,《人工辅助生殖指南》赋予人工受孕体已出生的人的地位,这样,形成了人工受孕体的地位高于自然受孕体的情势。由于法律对人工受孕体保护过度,牺牲了母亲的健康权以及胚胎的健康出生权,协调人工受孕体的利益与母亲及其家人利益的矛盾成为摆在法院面前的难题,它们通过把人工受孕体的法律地位从主体降低为受保护的客体达成了此等协调。
