当下文化领域“扫黄”行动的合理性分析

On Rationality of the Anti-porn Campaign in China

文化产品"扫黄"行动引发了来自民间和学界的关注,包括对其运动式治理方式的质疑,以及把"扫黄"和性犯罪问题联系在一起的争议。论文从淫秽色情的认定标准入手,结合理论分析和实证研究的结论对"扫黄"行动进行评价,从经验判断和事实判断两个维度肯定当下的"扫黄"行动,并对未来淫秽色情治理工作提供思路。

The anti-porn campaign in China has been igniteing controversy from the public and scholars. There are two main disputes, one is the way of mobilized governance and the other is relationship between pornography and the rate of sex crime. This paper analyzes the criterions of pornography, then evaluates the results of the campaign with theoretical analysis and empirical research. Based on the conclusions of value judgment and factual judgment, this paper affirms the legitimacy of the anti-pom campaign. At last, it also provides a proposal for governing pornography on policy implementation.
