Three Views on Victim's Promise—An Analysis Based on Different View Angles

对被害人承诺中的几个基本问题,不同的视角会有不同的结论。名称,从承诺人的视角为权利人同意,从社会一般人的视角则为被害人承诺;对象,从被害人方面是承诺,从行为人方面则为经承诺而为的行为;正当化根据,从行为的视角为规范违反,从结果的视角则为法益侵害。而不同视角的统一才是对被害人承诺的完整的认识。

Different conclusions will be got when we view some basic issues of victim＇ s promise from different angles. As to the name, it＇s obligee＇ s consent from the angle of promise while it＇s victim＇s promise from the angle of ordinary social man. As to the object, it＇ s promise from the angle of victim while it＇ s act after promise from the angle of actor. As to the legitimate accordance, it＇ s violation of norm from the angle of act while it＇ s infringement of legal interest from the angle of consequence. In fact, complete knowledge of victim＇ s promise can be obtained only by the unity of views from different angles.
