摘要
小产权房的出现虽然在一定程度上适应了社会现实的需要,满足了小产权房开发、建设以及销售等违法活动参与者的利益需求,但是违法小产权房也产生了明显的社会负效应,其破坏作用不容忽视,加强对小产权房的治理迫在眉睫。通过对小产权房的负效应进行分析有助于我们找到小产权房问题产生的原因。改革城乡二元土地制度、健全相关法律法规、完善城市住房供应体系与社会保障体制乃治本之策,分类处理只是在小产权房泛滥情况下遏制小产权房蔓延的一种权宜之计。
The emergence of small property room, to a certain extent, meets the needs of the social reality, in line with the interests of small property room development, construction, sales and other illegal activities of participants. But illegal small property room also has obvious social negative effect, the damage should not be ignored, and it is imminent to strengthen its governance. The analysis of the negative effects of small property room will help us to find the cause. It is fundamental to reform the urban and rural land system, improve the relevant laws and regulations, and perfect the urban housing supply system and social security system. Classification management is only the temporary solution to restrain the growth and spread of small property room.
