An Assessment of Translating Certain Criminal Offences——A Case Study of the English Version of The Criminal Law of the People's Republic of China

从比较法学与词源学的视角,结合法律翻译中的静态对等理论,探讨《中华人民共和国刑法》与英美法系典型国家所使用的相关刑事罪名的英语术语差异,评估了我国刑法英译本中的若干刑事罪名的翻译质量,旨在构建一个刑事罪名的翻译评估体系,以期为这些刑事罪名的正确翻译提供参考性建议。

This paper employs the static equivalence theory in legal translation. It studies the legal English terms for certain crimes in The Criminal Law of the People＇s Republic of China and the law in typical countries including Britain, America, or France, etc. from the perspectives of comparative law and etymology. And it makes an assessment of the translation of some typical crimes in China＇s Criminal Law. It aims to set up evaluative criteria for the translation of criminal charges and offer some suggestions on how to put those crimes correctly in the target language.
