刑事诉讼制度的每一次变革都会对刑事司法实践带来较大的冲击和影响,无罪辩护也不例外。2012年再修改的《刑事诉讼法》对辩护制度、证据制度和诉讼程序均进行了重大变革,可以预期这些制度变化将会对无罪辩护实践产生深刻影响。尽管《刑事诉讼法》的修改对无罪辩护的影响尚未充分表现,但初步分析表明,其对无罪辩护率、无罪辩护机制和无罪辩护效果都带来了较明显的积极影响。当然,这种积极影响不仅依赖制度本身的变革,还需要诉讼理念革新、司法改革成功及相关配套措施到位的保障。

Every reform in the criminal procedure system will exert a strong impact on the criminal judicial practice,including the innocent plea. The Criminal Procedure Law( 2012 Revision) changed significantly the defense system,the evidence system and the criminal procedure. It is,therefore,safe to say that those revisions of criminal procedure system will profoundly influence the innocent plea. We could come to the preliminary conclusion that the new Criminal Procedure Law has positive effects on the rate,mechanism and the result of innocent plea,though the overall influence those revisions bring about hasn't been fully demonstrated. The positive effects,however,rely not only on the reformation of the system,but also on the innovation of the action notion,the success of judicial reform and the support of relevant measures.
