拒不支付劳动报酬罪适用结果加重构成之我见

Opinion on the Aggravating Results Apply to the Crime of Refusing to Pay the Labor Remuneration Constitutes

现行刑法第276条规定,拒不支付劳动报酬罪适用两个量刑档,在未造成严重结果时适用3年以下法定刑和造成严重后果的适用3-7年的法定刑。司法实务中,一般认为实施了该罪的基本欠薪行为且造成了严重后果,即可适用结果加重犯构造理论。文章立足于目前结果加重犯各学说理论,结合拒不支付劳动报酬罪犯罪构成,予以提出作者自己对于该罪适用结果加重犯构的一些理解。

As prescribed in article 276 of the criminal law,refusing to pay the labor remuneration sin for two sentences,when not cause serious results for the following 3 years of legal punishment,will have serious consequences for 3 to 7 years of legal punishment.In the judicial practice,it is generally believed to implement the basic wage arrears behavior of this crime and the serious consequences caused by theory can be used to construct the aggravated consequential offense.Article based on the theo-ry of the aggravated consequential offense theory at present,it combined with the refuse to pay the labor remuneration crime crime constitution.It puts forward own some understanding about applicable structure of the aggravated consequential offense.
